Booking terms
I confirm that I am aware that I am boarding a charter fishing vessel to fish in open water and possibly in sites that are difficult for rescue vessels to reach, making it difficult for rescue, medical assistance, or other assistance.
I understand and assume the risks and hazards associated with deep sea fishing. These risks and hazards include, but are not limited to, the following:
Sun, rain, lightening, water spray, and other weather conditions, motion sickness, pitching and rolling, slippery and wet decks and surfaces.
Injuries – internal and external from: boarding and disembarking the vessel, fish, fishing, fishing tackle and gear, and the conduct of any other persons on the boat.
In consideration of being accepted to participate in this fishing trip, I hereby personally assume all risks and hazards of the activity, whether foreseen or not, that may occur while I am a participant.
I understand and agree that neither Noosa Watersports, nor its fishing charters operations manager may be held liable or responsible to me or my family or estate in any way for any injury, death or other loss or damage to me that may occur as a result of my participation in this fishing activity or as a result of the negligence of any person, including the released parties and other passengers on the vessel, whether passive or active.
Children under the age of 18 must have consent from parent or guardian.
I RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE any of the released parties in respect of anything arising from the fishing activity or any related rescue operations.
PHOTOGRAPHY
Noosa Watersports may take photographs on the vessel and publish the photographs on the website or in television or written media advertising for promotional purpose. Please advise if you do not wish any photographs to be taken for such purposes.
TURBULENT WEATHER
Sunshine Coast waters can experience rough weather conditions. On such occasions, the skipper has the discretion to decide whether to commence a trip or, if a trip has commenced, to seek shelter during the trip or return to shore.
CANCELLED TRIPS
In the event that a trip is cancelled due to weather-related circumstances, we cannot accept responsibility for any loss of trip costs, airfares, lost holiday time or any other financial consequences as a result of the booking.
Your safety is important to us. We make every effort to conduct all trips on time and to the proposed itinerary, however we are unable to take you fishing in the event that a tropical cyclone warning or a strong wind warning is issued by the Bureau of Meteorology for all or part of your trip. In the event of any other natural disaster that prevents us from running your trip, or if wind speeds exceed the safe operating limits specified for our operation by the Australian Maritime Safety Authority, we will be forced to reschedule your trip.
